Administering the estate of a loved one can feel like an overwhelming task during what is already a challenging time.  As an Executor, it may feel difficult to know where to begin, what steps to follow, and when it’s appropriate to distribute the estate’s assets.


In Ontario, acting as an Executor carries with it many duties and responsibilities.  A lawyer can help guide you through the process of administering the estate, prepare certain filings, draft documents, and advise you on how best to manage your personal exposure to liability.

When working with Executors, Nadia assists them by breaking down the administration of an estate into actionable items to simplify and manage the task.  With a checklist tailored to the particular estate to be administered, Executors understand what needs to be done and where they can ask for help. 


Nadia also assists with estate administration by:


  • Advising the Executor of their duties and responsibilities when administering an estate 
  • When there is a Will, reviewing and interpreting it for the Executor
  • When there is no Will, posting notices to determine whether a Will was ever prepared by the deceased and advising the Executor on who are the beneficiaries of the estate 
  • Explaining the probate process and preparing the Application for Certificate of Appointment of Estate Trustee (with a Will or without a Will) 
  • Explaining estate administration tax (commonly called, “probate tax”) and assisting with the preparation of related filings, including the Estate Information Return
  • Posting a notice to creditors of the estate
  • Providing legal advice to Executors throughout the administration of the estate 
  • Preparing such documents as receipts and releases on the distribution of estate assets
